Ken Hung is a Partner of Vivien Chan & Co. where his practice areas include dispute resolution, intellectual property, regulatory compliance and employment.

He has extensive experience acting for multinational brands in formulating strategy to secure and enforce intellectual property rights in China and Hong Kong.  He regularly assists foreign brands to go against squatters and paving the way of entering into the Chinese markets with the intellectual property rights properly secured and protected.

He also advises on regulatory compliance issues, from product labelling, trade descriptions, anti-trust and competition, data privacy, to employment related issues.  He helps clients in compliance review, formulating and drafting policies and guidelines, responding to queries and representing them before enforcement authorities for compliance issues.

Ken obtained his double degree in business and law from the University of Hong Kong and admitted in Hong Kong in 2013.  He also passed the Greater Bay Area Legal Professional Examination in China in 2022.  The Greater Bay Area comprises 9 municipalities of Guangzhou, Shenzhen, Zhuhai, Foshan, Huizhou, Dongguan, Zhongshan, Jiangmen and Zhaoqing in Guangdong Province, which is key to China’s strategic planning and innovation-driven development.  He is fluent in English, Mandarin and Cantonese.

REPRESENTATIVE EXPERIENCE
  • Acting for multinational brands in IP rights enforcement actions in Hong Kong and China, including issuing cease & desist letter, conducting administrative actions, liaising with officers from online platforms for complaints and evidence collection, and commencing litigations
  • Devised cross-border enforcement strategy for world's leading men's magazine brand against PRC infringers by striking off shadow companies in Hong Kong and simultaneously initiating administrative enforcement actions in Mainland China
  • Devised anti-counterfeiting strategy for Greater China for a global mobile device brand, covering enforcement actions at AMR, PSB, Customs and online as well as judicial redress, the use of expedited process in specialized IP court and collection of evidence on online platforms
  • Secured numerous favourable administration decisions based on unregistered character name rights and bad faith for a world-famous movie series
  • Represented multinational corporations in domain name arbitrations
  • Devised investigation strategies for a multinational pharmaceutical brand to crack down the supply of counterfeit vaccines at medical centers in Hong Kong
  • Established a precedent for enforcement against Mainland China online shops selling a leading direct selling company’s products with tampered product tracking devices based on trademark infringement
  • Advised an emerging animal-free dairy product brand in launching its first online selling platform on different legal aspects, including intellectual property, product labelling, product recall and other regulatory compliance issues
  • Advised a global leading education and examination organization on compliance of personal data collection and cross-border transfer requirements under the Personal Information Protection Law in Mainland China
  • Assisted in a dispute concerning the ownership of a convertible bond with substantial value issued by a Hong Kong listed company
  • Assisted in litigation proceedings concerning recovery of ownership of certain special purpose vehicles incorporated for the purpose of an initial public offering following abandonment of the listing proposal
  • Represented a large distributor in Hong Kong in handling contractual relationships with suppliers and retailers, including compliance issues from the competition laws perspective
